The Ordinance No. 233/2018
The Ordinance No. 233/2018, issued on August 21, 2018, regulates the Legal Regime of the Central Registry of the Beneficiary Effective approved by Law no. 89/2017, of August 21.
The present decree defines: the form for the declaration on the beneficiaries effective; the circumstances indicating the status of beneficial owner, the period in which the information of the Central Register of Legal Persons and of the Tax and Customs Authority (TA) is communicated to the Central Registry of the Beneficiary, the public disclosure of information about the beneficiaries effective; the authentication procedures of the obligated entities, as well as the search criteria; the terms of extraction of information and certificates from the database; the deadline for the first declaration for existing entities; the form and the deadline for communication by the entities obliged to their sectoral authorities of the identification of the entities to which they provide the services referred to in paragraph a) of paragraph 2 of article 3 of the Legal Regime of the RCBE, or with which maintain the business relations referred to in sub-paragraphs c) and d) of the same paragraph, for the purposes of paragraph 2 c) and paragraph 4 of article 22 of Law no. 89/2017 , of 21 August; the terms and the time limit for the confirmation and electronic communication to the RCBE, by the sectoral authorities, of the quality of subject entity, in accordance with Article 3 (a), (c) and (d) of the Legal Regime of the RCBE.
The ordinance will enter into force on October 1, 2018.
